Terms of Service for AI Image Generator

Please read these Terms of Service ("Terms", "ToS") carefully before using the AI Image Generator bot ("the Bot", "our Service"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all users and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Use of the Service

You must be at least 13 years old (or the minimum age required in your country to use Discord) to use the Bot. You are responsible for your use of the Service and for any content you provide, including compliance with applicable laws, rules, and regulations.

2. User Responsibilities and Prohibited Conduct

The AI models used by this Bot are governed by the CreativeML Open RAIL++-M License. As a condition of using our Service, you agree not to misuse the Service or help anyone else to do so. Specifically, you agree not to use the Bot to generate or disseminate content that:

• In any way violates any applicable national, federal, state, local, or international law or regulation.
• Is intended for the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
• Generates or disseminates verifiably false information and/or content with the purpose of harming others.
• Generates or disseminates personal identifiable information that can be used to harm an individual.
• Defames, disparages, or otherwise harasses others.
• Is intended for fully automated decision-making that adversely impacts an individual’s legal rights or otherwise creates or modifies a binding, enforceable obligation.
• Is intended for any use that has the effect of discriminating against or harming individuals or groups based on online or offline social behavior or known or predicted personal or personality characteristics.
• Exploits any of the vulnerabilities of a specific group of persons based on their age, social, physical, or mental characteristics, in order to materially distort the behavior of a person in a manner that causes or is likely to cause that person or another person physical or psychological harm.
• Is intended for any use that has the effect of discriminating against individuals or groups based on legally protected characteristics or categories.
• Is intended to provide medical advice or medical results interpretation.
• Is intended to be used for the administration of justice, law enforcement, immigration, or asylum processes, such as predicting an individual will commit fraud or crime.

We reserve the right to block or terminate your access to the Service for any violation of these terms, at our sole discretion.

3. Content Ownership and Rights

Your Content: You retain full ownership rights to the images and other content you generate using the Bot ("Generated Content"), subject to the restrictions outlined in Section 2. We claim no ownership over your Generated Content.

Our Service: We retain all ownership and intellectual property rights to the Bot itself, including its code, design, and branding.

4. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranty that the Service will meet your requirements, be available on an uninterrupted, secure, or error-free basis, or that the results obtained from the use of the Service will be accurate or reliable. The output of AI models can be unpredictable, and we do not guarantee the quality or suitability of any Generated Content.

5. Limitation of Liability

In no event shall AI Image Generator, nor its developers, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

6. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide notice of any changes by posting the new Terms on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
